AC Pro Contractor Store’s Notice of Rights for California Consumers Under the California Consumer Privacy Act

This Privacy Policy for California Consumers supplements the information contained in the AC Pro Contractor Store Privacy Policy and applies only to personal information of California consumers (“you”), as defined under the California Consumer Privacy Act of 2018, Cal. Civ. Code §§ 1798.100, et seq. (“CCPA”), that is collected by AC Pro Contractor Store.

We adopt this Privacy Policy to comply with the CCPA and other California privacy laws. Any terms defined in the CCPA have the same meaning when used in this policy. AC Pro Contractor Store may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes.

• Directly from you or your agents. For example, when you provide your name and credit card for a transaction.

• Indirectly from you or your agents. For example, through information we collect from you in the course of providing goods or services to you.

• Directly and indirectly from activity on our website. For example, when you sign up for an account on our website or website usage details collected automatically.

We collect the categories of personal information listed above for the following business or commercial purposes:

• To fulfill the reasons for which the information was provided. For example, if you provide us your email address to sign up for an online account, we will use that information to create and maintain the account.

• To provide you with information, products, or services that you request from us. For example, if you provide us with your email address to inquire about our return policy, we will use that information to respond to your inquiry.

• To provide you with email alerts, event registrations, promotional offers, and other notices concerning or products or services or events or news that may be of interest to you.

• To carry out our obligations and enforce our rights arising from any agreements entered into between you and us, including for purchases, billing, and collections.

• To improve our website, mobile application, store experience, and product development.

• For testing, research, analysis, and product development.

• As necessary or appropriate to protect the rights, property, or safety of you, AC Pro Contractor Store, or others.

• As described to you when collecting your personal information or as otherwise permitted by the CCPA.

• For purposes exempted by the CCPA, such as to comply with federal, state or local laws; comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, or local authorities; cooperate with law enforcement agencies; exercise or defend legal claims; collect, use, retain, sell, or disclose personal information that is deidentified or aggregated; or collect personal information if every aspect of that conduct takes place wholly outside of California.

We disclosed personal information for a business or commercial purpose to the following categories of third parties: our affiliates, service providers, and third parties to whom you or your agents authorize us to disclose your personal information in connection with products or services we provide to you.

In the preceding 12 months, we did not sell any personal information for a business or commercial purpose.

Note that personal information does not include the following categories, as they are exempted from the CCPA: publicly available information from government records; de-identified or aggregated consumer information; health or medical information governed by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and California Confidentiality of Medical Information Act (CMIA) or clinical trial data; information collected as part of a clinical trial subject to the Federal Policy for the Protection of Human Subjects; certain personal information under the Fair Credit Reporting Act, Gramm-Leach Bliley Act, California Financial Information Privacy Act, and Driver’s Privacy Protection Act of 1994.

Description of Your Rights Under the CCPA

1. You have the right to request that AC Pro Contractor Store disclose to you: (1) the categories of personal information it has collected about you; (2) the categories of sources from which the personal information is collected; (3) the business or commercial purpose for collecting or selling the personal information; (4) the categories of third parties with whom AC Pro Contractor Store shares personal information; and (5) the specific pieces of personal information it has collected about you. Instructions for submitting a request to know can be found below.

2. You have a right to request the deletion of your personal information collected or maintained by AC Pro Contractor Store. Instructions for submitting a request to delete can be found below.

3. You have a right not to receive discriminatory treatment for your exercise of your rights under the CCPA. Prohibited discriminatory treatment would include but is not limited to denying goods or services to you; charging different prices or rates for goods or services, providing a different level or quality of goods or services to the consumer; suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services. However, AC Pro Contractor Store is not prohibited from charging you a different price or rate, or from providing a different level or quality of goods or services to you, if that difference is reasonably related or directly related to the value provided to you by your personal information. AC Pro Contractor Store is also not prohibited from offering financial incentives for the collection, sale, or deletion of personal information.

Submitting requests for disclosure or requests to delete personal information 

A verifiable consumer request, as defined in the CCPA and regulations adopted by the Attorney General, means a request that is made by you, by you on behalf of your minor child, or by a natural person or person registered with the California Secretary of State that you authorize to act on your behalf, and that AC Pro Contractor Store can reasonably verify to be the consumer about whom we have collected personal information. We are not obligated to provide information to you in response to a request for disclosure if we cannot verify that the consumer making the request is the consumer about whom we have collected information or is a person you authorized to act on your behalf.

You may only make a verifiable consumer request twice in a 12-month period. Making a verifiable consumer request does not require you to create an account with us. For requests for disclosure, if we cannot verify the requester’s identity from the information already maintained by us, we may request additional information from you, which shall be used only for the purposes of verifying the requester’s identity and for security or fraud prevention purposes. For requests to delete, if we cannot verify the requester’s identity, we may deny the request to delete, and will inform the requester that their identity cannot be verified, and that the request will be treated as a request to opt out of sale.

We will strive to respond to verifiable consumer requests within 45 days of receipt. If we require additional time (up to 90 days total), we will provide you with a notice and explanation for why additional time needed. If we do not take action in response to a request, we will inform you within 45 days of receipt (or within 90 days, per the above notice and explanation) of the reasons for not taking action and any rights you may have to appeal the decision to us.

If a request is manifestly unfounded or excessive, we may either charge you a reasonable fee or refuse to act on the request and notify you of the reason for refusing the request.

In response to a verifiable consumer request for disclosure, our disclosure will cover the 12-month period preceding our receipt of the request and will be made in writing and delivered through your account with us, if available, or by mail or electronically, at your option.

In response to a verifiable consumer request to delete, we will permanently and completely erase the personal information on our existing systems with the exception of archived or back-up systems; de-identifying the personal information; or aggregating the personal information. We will specify the manner in which we have deleted the personal information and will notify you that we will maintain a record of your request pursuant to the CCPA’s requirements.
